Stopping Foreclosure

Rochester Foreclosure Lawyer

Stop Home Foreclosure

Is your house being foreclosed on? Or, do you fear that it will be soon? The thought of losing your home because of unpaid mortgage bills can be terrifying and it can leave you feeling helpless.

The fact of the matter is that you aren't helpless. I, Rochester foreclosure attorney Robert A. Schwartz, can explain to you how you can stop foreclosure and so you can have an opportunity to sell your home or bring your mortgage current through Chapter 13 bankruptcy.

Saving Your Home Through Bankruptcy

For more than 30 years, I have helped residents of Rochester, New York, stop foreclosure on their homes by filing for Chapter 7 or Chapter 13 bankruptcy.

How does bankruptcy help? As soon as you file for Chapter 7 or Chapter 13 bankruptcy, an injunction known as an automatic stay will immediately stop home foreclosure proceedings, as well as all other creditor collection activity, and liens or garnishments of your wages.
If you file for Chapter 7 bankruptcy, the automatic stay may give you the time you need to sell your home. Automatic stays usually last 30 days but can be affected by claims from secured creditors.
During Chapter 13 bankruptcy, an automatic stay works the same as in Chapter 7 bankruptcy, but after the automatic stay ends, you are left with a repayment plan instead of liquidation of your assets. The reorganization of your debt in Chapter 13 allows you to pay back your delinquent mortgage payments, bank charges and other debt over a three- to five-year period without additional interest.

I understand your concerns about filing for bankruptcy, and I will address each one during a free initial bankruptcy consultation when you contact my law office. I am committed to learning about each one of my clients and their financial situations, and I am ready to learn about you, too. This will assist me in determining what type of bankruptcy option is best suited to your needs.
